CROSSVILLE, Tenn. – A Tennessee father is outraged after being arrested for attempting to pick up his kids from school last week.

parent arrestedJim Howe, a father of two children at South Cumberland Elementary, was arrested by the school resource officer after a series of encounters in the main office.

The disagreement began after Howe refused to wait in a long line of traffic to pick his kids up from school, reports Wate.com.

Howe said, because of a new policy that started last week, the only way parents can get their children after 2 p.m. is to wait in a long line of cars until everyone is released at 2:35.

He not only believes that the new policy is time consuming, but dangerous and illegal as well.

In a video Howe took, cars can be seen lined up on the side of a busy highway an hour before and more than an hour after school was completed.

“You don’t need a reason as a parent to go get your children. They are our children,” Howe said in the report.

The father attempted to bypass the traffic and protest the policy by walking to the school to pick up his children rather than driving.

He was met in the office by the school resource officer, Deputy Avery Aytes. Howe’s fiancé, Amanda Long, recorded the entire encounter.

“I’m not raising my voice, I’m not confrontational, I want my kids,” Howe can be heard saying in the video.

The video also shows the dad arguing with Deputy Aytes over state law, and Howe eventually winding up in handcuffs.

“I’m going to call some help down here and we’re going to take you up to the jail right now. I’m not putting up with this today. You’re being childish and it’s uncalled for,” the deputy said in the recording.

Howe was ultimately arrested for disorderly conduct. The Deputy also threatened to arrest Howe’s fiancé as well, after she was standing in the way of traffic for a few seconds.

Cumberland County Sheriff Butch Burgess said that Deputy Aytes was just doing his job, according to WATE.

“The resource officers are there to enforce the law,” Burgess said.

However, the sheriff also said that he agrees with Howe on principle and believes the new policy is creating safety concerns.

Howe said he understands the need for appropriate school policy but disagrees with the actions of Deputy Aytes.

“If not for policy, we would have chaos, and we don’t need chaos at the schools, but we also don’t need an overzealous deputy setting an example in front of kids,” said Howe.

WATE reports the sheriff will review the school’s policy and will make recommendations this week as to what changes should be made to ensure student
safety.
