LEBANON, Ohio – An Ohio school bus driver dodged criminal charges after he allegedly punished his rowdy passengers by making them roll up their windows and sit in the 90-degree heat until “their brains melted.”

“The city of Lebanon’s prosecutor said Tuesday that the facts of the case do not support the notion that Benjamin Spaulding’s action on Aug. 25 were reckless or caused a substantial risk to health and safety,” WLWT.com reports.

Spaulding was put on administrative leave and later resigned from his position as a bus driver for Lebanon City Schools after an anonymous parent complained that their daughter felt lethargic following a school bus ride home Aug. 25.

“She gets headaches but she’s not usually lethargic. She just came home and wanted to go to bed and ended up staying in bed until 8 p.m.,” the father of an 11-year-old WLWT.

“He said that the kids were being rowdy and wild and the bus driver pulled over to the side of the road and told everyone to put up their windows and said he was going to leave them sit there until their brains melted,” the parent complained.

Lebanon police confirmed Spaulding picked up students at Berry Intermediate School, and made a second stop for students at Bowman Elementary School before he pulled over and told his passengers to roll up their windows. He then allegedly forced the students to sit in the hot bus for 20 minutes.

The news site reports temperatures reached 90 degrees in some parts of the Tri-State area on the day of the incident.

The anonymous parent told the media he double-checked his daughter’s story before raising concerns about the issue.

“And then I kind of had a little calming down period and sat her down and had a talk with her and was basically like, ‘Are you exaggerating?’ She stuck by her guns and said it was 100 percent accurate,” the father told WLWT.

The parent said “I would like to see something on his record where he can’t work with children, elderly or disabled anymore.”

According to a news release, no students suffered physical injuries because of Spaulding’s actions.
