LOS ANGELES – Parents of a special needs student who was allegedly raped by another student at a Los Angeles middle school plan to sue the Los Angeles school district, an attorney for the family announced Monday at a press conference.

The 13-year-old boy is a special needs student at Barack Obama Global Preparation Academy. His parents say he has the mental capacity of a six-to-eight year old.

Family attorney Brian Claypool said the seventh-grader was left unsupervised earlier this month when he was allegedly lured behind a set of gymnasium bleachers  and sexually assaulted by an unidentified eighth grade male student, reports KTLA5.

The victim reportedly told other boys during an after-school program what had happened. The boys notified a supervisor, who called police.

The victim’s mother said she filed a complaint with the school two months ago after a teacher told her that her son was being bullied in gym class, but she says administrators did not respond.

The victim’s parents say school officials should face charges for criminal child endangerment.

“This should never take place – not just to my son, any kid,” the alleged victim’s father said at the press conference.

Claypool said the incident is part of a “continued systematic breakdown” in the beleaguered school district, and represents a failure to adequately train staff and safeguard students, according to the news site.

“How was he wandering throughout the school, running around, recruiting another boy to have sex with him behind a bleacher?” Claypool asked reporters. “Does anybody at LAUSD care where the kids are during a class?”

School officials would not comment on specific allegations, but the district did release a statement concerning the investigation.

“Allegations of student-on-student misconduct are taken seriously,” read the statement. “Upon learning of the allegations, the school acted to appropriately document and notify authorities of the suspected abuse. Although we cannot comment on the specific allegations or any potential lawsuit in this case, we are committed to ensuring student safety at all times.”

The alleged victim’s mother said the district needs to “stop using a band-aid to cover a huge wound.”

“You can tell he’s ashamed,” she said of her son. “I mean, if I were raped or assaulted, I would be ashamed.”

The Los Angeles Police Department has opened a criminal investigation of the incident.
